NCAT is the primary dispute resolution body for residential tenancy matters in NSW. Either landlords or tenants can apply. Since 2025, landlords in NSW must provide a valid reason to terminate a tenancy, including a genuine sale of the property, renovations requiring vacant possession, or a serious breach by the tenant. Termination notices without a valid stated ground can now be challenged and set aside by NCAT in Sydney.
Rent increases during a fixed-term tenancy in NSW are only permitted if the agreement explicitly allows for them and contains a specific formula or method for calculation. Open-ended increases are not enforceable. Landlords must also provide at least 60 days’ written notice before any rent increase takes effect.

A fixed-term lease commits both parties for a specified period, typically six or twelve months, with stronger protections for tenants during that term. A periodic tenancy has no fixed end date and operates on a rolling basis. Different notice requirements and termination rules apply to each under the NSW residential tenancy law.
